Abstract
The article argues that, in legal terms, the auction winner is the buyer of the sale contract and enters into a contract with the asset auction organization, but Vietnamese law only recognizes this person as the person who accepts the transaction. entering into a contract, and at the same time being a depositor to enter into or perform a sale contract without actually being recognized as the buyer in the sale contract; To become the buyer in the contract, the auction winner must need more time and procedures to enter into a contract with the auctioned asset owner. The article points out some inadequacies arising from the above mentioned provisions of Vietnamese law, and also makes some recommendations.
