Abstract

This article analyzes and ascertain the competence to settle cases regarding the determination of parent-child relationship with no dispute, based on the consistent connection of three related legislative documents including: the Law on Marriage and Family 2014 as a substantive law, the Civil Procedure Code 2015 in term of procedures at the People's Court and the Civil Status Law 2014 for administrative procedures. Analyzing the provisions of current law and comparing with its actual application regarding the competent authority when determining the parent-child relationship in the absence of dispute shows that many perplexities and entanglements do exist. The author therefore proposes a unified understanding of the current legal provisions in this case, aiming to contribute to the improvement of law application in actual.
